Smoke damage can be part of a homeowners claim, but your policy and your adjuster decide what is covered. Document every affected room before cleaning, report the claim quickly and keep receipts.
If you need a restoration company to document and clean the damage, call (855) 727-0147 and we’ll connect you with one that serves your area.
Is smoke damage covered by homeowners insurance?
It depends on your policy and the cause. Check your declarations page and policy wording, and ask your adjuster. Smoke can reach rooms the fire never touched, so report everything you see and smell.
How do I document smoke damage?
- Photograph and film every room, including closets, cabinets and the attic access.
- Capture soot on walls, ceilings, vents and light fixtures.
- Note where you smell smoke, even if you can’t see residue.
- Photograph damaged belongings, with labels or serial numbers where possible.
- Keep the HVAC filter if it is black with soot, and photograph it.
- Keep receipts for everything you spend because of the damage.
Who does what in a smoke damage claim?
| Who | Their role |
|---|---|
| You | Report the claim, document damage, prevent further damage, keep receipts and decide what to approve. |
| Restoration company | Inspects, documents residue and odor, writes a scope and estimate, and does the work you approve. |
| Insurance adjuster | Reviews the damage and estimates, and decides what the policy covers. |
| Texas Department of Insurance | Regulates insurers and helps consumers with claim problems. |
A restoration company can’t negotiate your claim for you. Texas law bars a contractor that does the work from acting as a public adjuster (TDI).
How long does the insurer have to respond?
In Texas, an insurer has 15 business days to acknowledge your claim. After it receives what it needs, it has 15 business days to accept or deny, or 45 more days if it explains why (TDI).
What about my deductible?
You pay it. Texas law bars contractors from offering to waive, rebate or absorb your deductible. TDI lists the Texas Attorney General’s line, 800-621-0508, for reporting violations.
Can I get help with living costs?
If covered smoke damage makes your home unlivable, additional living expenses coverage may pay for a hotel, meals and laundry. TDI says most home, renters and condo policies include some (TDI).
What if I disagree with the adjuster?
- Ask the adjuster to explain the decision in writing.
- Share the restoration company’s documentation, such as photos and residue notes.
- Get a second estimate if the scope looks incomplete.
- Call the Texas Department of Insurance help line at 800-252-3439, or file a complaint.
